“Open Goldberg Variations – BWV 988 – 10 – Variatio 9 a 1″ Youtube Upload: False Claims and Disputes Report

October 10, 2013

Source Type: Sound Recording
Source: “Goldberg Variations – BWV 988 – 10 – Variatio 9 a 1”
Music by J.S. Bach, 1741
Recording/Performance on Piano by Kimiko Ishizaka
Released as part of the Open Goldberg Variations Project and funded on Kickstarter

Notes on Copyright Status:

Bach’s music, the Open Goldberg Variations, are in the public domain due to having been written in 1741, making them too old to be copyrighted in the U.S.

Kimiko Ishizaka’s recording of her performance of the Goldberg Variations is in the public domain because she released it into the public domain using the Creative Commons Zero Waiver on May 28th, 2012.

False Copyright Claims on This Recording:

Two claims were made. One is the common claim by “one or more” music publishing rights collection societies. The other is listed as registered to “Public Domain Compositions.”

Information On My Attempts to Contest These Claims:

I was unable to find any contact information, or any information at all about who or what “Public Domain Compositions” is. Obviously it is rather suspect that a company can claim copyright on materials when its very name declares that the material it claims to possess are in the public domain.

As of 9/17/2012, lacking any contact option, I filed a claim dispute via Youtube on the grounds that the work I uploaded neither belonged to anyone claiming ownership of it and that Kimiko Ishizaka dedicated it to the public domain. I will update this page when I either get a response to something changes.

Apparently all copyright claims have been released. I was given no email update about this so I’m unsure of exactly when this was done, but I noticed it on 10/3/2012.
