“Open Goldberg Variations – BWV 988 – 08 – Variatio 7 a 1″ Youtube Upload: False Claims and Disputes Report

October 10, 2013

Source Type: Sound Recording
Source: “Goldberg Variations – BWV 988 – 08 – Variatio 7 a 1”
Music by J.S. Bach, 1741
Recording/Performance on Piano by Kimiko Ishizaka
Released as part of the Open Goldberg Variations Project and funded on Kickstarter

Notes on Copyright Status:

Bach’s music, the Open Goldberg Variations, are in the public domain due to having been written in 1741, making them too old to be copyrighted in the U.S.

Kimiko Ishizaka’s recording of her performance of the Goldberg Variations is in the public domain because she released it into the public domain using the Creative Commons Zero Waiver on May 28th, 2012.

False Copyright Claims on This Recording:

Two false copyright claims were made on this recording. Here is a copied-and-pasted list of them from the copyright claims page of this upload:

“Variation 7”, musical composition administered by:
GoDigital MG For a Third Party
One or more music publishing rights collecting societies

Notes on the Claims and Claimants: GoDigital MG is a company I’ve dealt with before. The website for the GoDigital Media Group is inaccessible for me, listing as “Forbidden.” Links from other posters angry about their false copyright claims/false content ID matches I’ve found online are expired. I can access the website of a company called “GoDigital” at, but I am unsure if it is the same company. In my past dealings with them, I was unable to get a reply from the contact email address nor a response to a claim dispute. The results of that dispute are still pending, as Youtube gives claimants a month to respond. I’m not sure what happens after that.

The “one or more music publishing rights collecting societies” claim has appeared on nearly ever other Open Goldberg Variations video I’ve uploaded. In each case, their claim was instantly, and presumably, automatically released the very moment I filed a claim dispute on the grounds that the work I’ve used is in the public domain.

Information on My Attempts to Contest the Claims:

As of 9/16/2012, I have emailed GoDigital at the email address I am not entirely sure this is the correct company but the address for GoDigital Media Group’s website would not allow me access. I will give them 24 hours to reply and then file a claim dispute on Youtube. Having dealt with them before on another account, I do not expect a response, but we will have to wait and see what happens.

Update 9/17/2012: I have just been informed that GoDigital MG, after several weeks, released the copyright claim on a video on the Youtube channel TheJeremyKellerman that used a public domain recording by the US Navy Band downloaded from Musopen. Now that I have evidence that GoDigital will respond, even if after considerable time has passed, I’ve decided not to wait a full 24 hours and follow up my email to them with a Youtube copyright claim dispute. I will update when GoDigital responds, or fails to within the month time limit Youtube sets for copyright claimants to respond to a dispute.

Update, late afternoon 9/17/2012:

Both the “one or more” collecting societies and Go Digital MG for a Third Party have reviewed my claim dispute and released their claims. This upload is now false copyright claim-free and ad-free.

Contact Info for Claimant:

I’m unsure if the GoDigital company found at is the same as the GoDigital MG company with the claim on this video, but if it is, their contact info is: and can be found here:
